1. Introduction
Welcome to Martin Development LLC. By accessing or using our services, you agree to be bound by the following terms and conditions. Please read them carefully.
2. Services Provided
Martin Development LLC specializes in building quality homes that are both functional and beautiful. Our services include:
Residential Home Construction Townhome Development Custom Home Design and Build Renovations and Extensions
3. Quotations and Estimates
All quotations provided are valid for 30 days from the date of issue. Any acceptance of a quotation after this period may be subject to adjustments.
4. Contracts and Agreements
Upon acceptance of a quotation, a formal contract will be drafted outlining the scope of work, timelines, payment schedules, and other pertinent details. Both parties must sign this contract before any work commences.
5. Payment Terms
Payments are structured as follows:
Deposit: A non-refundable deposit of 10% is required upon signing the contract. Progress Payments: Subsequent payments will be due at agreed-upon milestones, as detailed in the contract. Final Payment: The remaining balance is due upon completion and final inspection of the project.
Late payments may incur interest charges as specified in the contract.
6. Variations and Changes
Any changes to the agreed-upon scope of work must be documented in a written change order, detailing the nature of the change, cost implications, and adjustments to the timeline. Both parties must approve and sign this document.
7. Warranties and Defects
Martin Development LLC offers a one-year warranty on workmanship and materials from the date of substantial completion. This warranty covers defects arising from our construction processes but excludes:
Normal wear and tear Damage caused by misuse or neglect Issues arising from unauthorized modifications
Clients must notify us in writing of any defects within this warranty period to be eligible for repairs or replacements.
8. Compliance with Tennessee Laws
We adhere strictly to all local and state regulations, including obtaining necessary permits and ensuring that all work meets the Tennessee building codes and standards. Clients are responsible for providing accurate information regarding property boundaries and any existing easements or restrictions.
9. Limitation of Liability
Martin Development LLC shall not be liable for:
Delays caused by factors beyond our control, such as adverse weather conditions or supply chain disruptions. Indirect or consequential losses arising from the project. Any loss or damage that exceeds the total contract value.
10. Termination
Either party may terminate the contract under the following conditions:
By Client: If Martin Development LLC fails to perform its obligations as outlined, after providing written notice and a reasonable opportunity to remedy. By Martin Development LLC: If the client fails to make payments or otherwise breaches the contract terms, after providing written notice and a reasonable opportunity to remedy.
Termination must be communicated in writing, and any work completed up to the termination date will be invoiced accordingly.
11. Dispute Resolution
In the event of a dispute, both parties agree to first seek resolution through mediation. If mediation fails, the dispute will be subject to arbitration in accordance with Tennessee state laws.
12. Governing Law
These terms and conditions are governed by the laws of the State of Tennessee. Any legal actions arising from this agreement shall be filed in the appropriate courts of Tennessee.
